Right to Information
The Queensland Government introduced a legislative framework in 2009 to encourage greater access to government information, including that of local government. This framework incorporates the Right to Information Act 2009 and the Information Privacy Act 2009.
The object of the Right to Information Act 2009 is to provide a right to access to information held by the government unless, on balance, it is contrary to the public interest to provide that information.
The Information Privacy Act 2009 provides a framework for the fair collection and handling of personal information, and access and amendment rights to a person's own personal information.

Correcting information
Members of the public have a right to request amendment to their personal information on record with Council if they believe this personal information is inaccurate, misleading, out of date or incomplete. If you believe Council hold personal information of yours which may be inaccurate, misleading, out of date or incomplete, you should complete the Information Privacy Personal Information Amendment Application Form.
Application process
To access Council's documents, an application can be made under the Right to Information Act 2009 for non-personal information or the Information Privacy Act 2009 for personal information by completing a Right to Information and Information Privacy Access Application.
Before entering into the application process, please consider whether the documents may already be available through other means, such as our Publication Scheme, Council's website or by contacting the relevant department within Council. Right to Information Fees and Charges, Timeframes and Review Rights
Application Fees |
Right to Information Application Application fees are set by the State Government in Section 4 of the Right to Information Regulation 2009 and increase annually on 1 July. The current application fee is $55.75. Following a submission of your application, a Customer Contact officer will be in touch with you to arrange for payment over the phone via credit card or alternatively, the application fee can be paid in person by cash, cheque or eftpos at any of Council's customer service centres. Processing Fee |

Access Charges |
Access charges are set by the State Government in Part 3 of the Right to Information Regulation 2009 and represent cost recovery or a flat fee for photocopies (which may increase annually on 1 July). Details of the Access Charges can be found HERE. There are currently no access charges payable for documents provided by email or on a disc. |

Timeframes |
The processing period for an application is 25 business days, subject to extension(s) in accordance with the Right to Information Act 2009 or by agreement between the Applicant and Council. |

Review Rights |
Applicants have 20 business days to lodge an internal review with Council or an external review with the Office of the Information Commissioner (OIC) from the date of their decision notice. |

The Privacy Principles contained in the Information Privacy Act 2009 establish requirements about how public authorities such as Council can collect, store, use and disclose personal information (Personal information means any information from which your identity is apparent or can reasonably be ascertained).

Disclosure Log
The Disclosure Log provides documents released in response to information requests made under the Right to Information Act 2009 where they do not contain the applicant's personal information or are otherwise unsuitable for publication according to legislation.
- Where possible electronic links will be provided in the Disclosure Log to released documents.
- Where documents have been determined suitable for release they are provided in PDF format.
- If a copy of the information on our Disclosure Log is required in an alternative form, please contact us and we will endeavour to provide it to you in a more suitable format.
- If a document is not provided electronically please contact us to determine how to access a copy of the document.

Note: If a Right to Information Application has not yet been finalised or the only documents released contain the applicant's personal information, in accordance with the Right to Information Act 2009 the information will not be displayed in the Disclosure Log. In some cases, deleting information under Section 78 of the Information Privacy Act will result in no text remaining in a document. Blank pages may exist due to redaction through the decision-making process (e.g. where a page contains irrelevant information or access to the document was refused). If a page is blank it will not be included in the Disclosure Log.
