Taking over an existing food business
Before purchasing an existing food business, it is recommended that an application is made for a Health Search to be conducted by Council’s Health Services. A Health Search is an inspection for fee and a report is provided outlining any non-compliances. You may also want to apply for other searches - such as planning, building and plumbing.
If you are taking over an existing licensed food business you will need to submit a Food Business Amendment Approval Form to Council with the relevant fee. Please note the amendment application must be signed by the current licensee of the food business and proposed licensee to change the licence to the new operator’s name. Otherwise the new operator must submit a new Application for Food Business Licence to Council.
You must also notify Council of any changes to the food safety supervisor or their contact details within fourteen days of the change. You can do this by submitting a Food Approval Amendment form. This form is available on Council’s website or from the Customer Service Centres. There is no fee for nominating or amending a food safety supervisor.

If you are intending to make changes to an existing premises, you should contact Council before undertaking any work for advice on the legislative requirements to ensure the design, materials and equipment you select will comply with the Food Safety Standards and Australian Standard AS4674-2004, click here for a the Fit out Guide and refer to Stage 2. Examples of significant modifications include relocating or installing new basins, exhaust canopy, tandoori oven or smoker/BBQ.
